Wills, Powers of Attorney and Deceased Estates

    Wills

Making a will is extremely important as it ensures that your possessions are dealt with in the way you would want them to be in the event of death. A Power of Attorney gives someone else the power to make decisions on your behalf. Both must be completed properly in order to be legally valid. HCB can assist you with this.

Without a will, your possessions could go to people who you did not intend them to go. By making a will, you protect your interests and have your intentions carried out.

    Powers of Attorney

If you propose being absent from your usual town or city of residence and need someone to make decisions for you in your absence, you can complete a Power of Attorney giving someone else the power to deal with matters on your behalf, either in general or in relation to specific tasks.

    Enduring Power of Attorney

You can also make an Enduring Power of Attorney which is a document that gives someone else the power to make decisions on your behalf when you cannot through illness or some other reason for incapacity. You can choose now what powers are delegated and who will exercise them for you.

    We can help you with:

    • a Will spelling out your directives

    • a Power of Attorney enabling someone to deal with your affairs (specific or general)  during your absence on business or holiday

    • an Enduring Power of Attorney that gives clear directions in matters such as finance, health and personal matters

    • Updates and changes to these documents

    Deceased Estates

We make probate and transmission applications and attend to all requirements through to the final distribution of the estate.

We also deal with general claims against deceased estates and disputes over wills and estates.

    Mediation

This is now a recognised method of dispute resolution which is less formal and less expensive and not so time consuming as the more traditional method of a formal court hearing.  If you would like more detail on this, consult with our registered mediator.
